This application is filed for grant of regular bail in connection with Naokothi P.S. Case No.73/2020 registered under section 30(a) of the Bihar Prohibition and Excise Act, 2018 and petitioner is in custody since 27.05.2021. The prosecution case in brief is that the informant Pappu Kumar son of Masudan Mahto has lodged the F.I.R. against one Shambhu Mahto and twelve other named accused including 4-5 unknown person stating that someone was calling his father from the door of the house, when they went to the door of the house then they saw that the twelve accused persons

Patna High Court CR. MISC. No.22800 of 2023(2) dt.17-05-2023 2/2 including the petitioner were standing having arms in their hands. It is further alleged that they were trying to take away his father forcefully, when his father denied then co-accused Krishna Kumar fired on his father, when his mother came to rescue his father then co-accused Shatrughan Kumar fired on his mother and both father and mother fell down after getting shot, it is also alleged that due to land dispute earlier to the occurrence petitioner alongwith others, made threats for dire consequence.

Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the period of custody and the allegations leveled against the petitioner, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge II, Begusarai in connection with Naokothi P.S.
