JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-12-2018 The petitioner seeks bail in connection with Madhepur P.S.Case No. 35 of 2018 registered under Sections 395 and 397 of the Indian penal Code and 27 of the Arms Act. Allegation, as per the FIR, is that some miscreants came to the petrol pump of the informant and taken away Rs. 12,32,615/- and mobile of the informant and after some time, he received information that looted was also committed at Nisha Fuel Centre Petrol Pump and Rs. 3,75,000/- was looted there and Rs. 51,000/- was taken from Nozal Man. It is alleged that photo of the miscreants were captured in the CCTV footage. Petitioner is not named in the FIR.

Submission of learned counsel for the petitioner is that except confessional statement, there is nothing against the petitioner. Neither anything has been recovered from the

He submits that petitioner has no criminal antecedent and is in custody since 01.09.2018 and charge sheet has been submitted against him and other co-accused persons, having similar allegation, have been granted bail by the co-ordinate Benches of this Court vide order dated 30.07.2018 passed in Cr. Misc. No. 42538 of 2018, order dated 20.09.2018 passed in Cr. Misc. 55338 of 2018 and order dated 27.11.2018 in Cr. Misc. No. 67571 of 2018.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-II, Jhanjharpur, Madhubani in connection with Madhepur P.S. Case No. 35 of 2018 with condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
