ANJANA MISHRA ORAL ORDER 31-08-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in C. Case No.2447/13, tr.No.4691/14 for the offence under Sections 498 (A), 406 of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act.
It is submitted that there has been a compromise between the parties in which a settlement has been arrived at and the petitioner has paid a substantial amount of the same. It is also submitted that the rest amount will be paid within eight weeks from today.
Learned counsel for the opposite party no.2 does not
Patna High Court Cr.Misc. No.49010 of 2014 (7) dt.31-08-2015 2/2 object to the same.
Considering the fact that the matter has been resolved between the parties, let the petitioner, above named, in the event of his arrest or surrender before the court below within three weeks from today be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of S.D.J.M., Gopalganj, in C.Case No.2447 of 2013, Tr.No.4691/14 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
It is made clear that if the aforesaid amount which is due is not paid to the opposite party, as submitted by the learned counsel for the petitioner, the order passed today shall stand recalled. (Anjana Mishra, J) AnilKrSinha/- U T
