Public Prosecutor as well as Sri Ashok Kumar Prasad, learned counsel, who has appeared on behalf of opposite party no. 2.

The present petition has been filed with a prayer to restore Cr. Misc. No. 28664 of 2012, which stood dismissed on 02-05-2014, due to non-prosecution.

Learned counsel for opposite party no. 2 has opposed the prayer for restoration. He submits that the petition stood dismissed in the month of May, 2014, whereas, the restoration petition has been filed after more than one and half years without any plausible explanation.

However, after hearing the parties and considering the ground set forth in the petition, same is allowed. Let Cr. Misc. No. 28664 of 2012 be restored to its
