This is an application for grant of regular bail for offences punishable under Section 304 (B) and 34 of the Indian Penal Code.

Petitioner is the cousin of the husband of the deceased. It has been submitted on behalf of the petitioner that petitioner is not directly involved in the present case. Petitioner is the cousin of the husband of the deceased and there is no specific allegation of overt act has been levelled against this petitioner and he has been languishing in judicial custody since 18.07.2016 and the charge-sheet has also been submitted.

Patna High Court Cr.Misc. No.54139 of 2016 (2) dt.22-12-2016 2/2 Learned A.P.P., appearing on behalf of the State submitted that several witnesses have supported the case of the prosecution. However, he could not controvert the fact that except general and omnibus allegation, there is nothing against the petitioner.

Having heard both sides and in view of the fact that no specific allegation of overt act has been levelled against the petitioner and he has been in judicial custody since 18.07.2016, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of Mr. Deepak Kumar learned Judicial Magistrate - 01st Class, Barh in connection with Saksohra P.S. Case No. 11 of 2016.
