This is an application for bail in connection with A.P.M. P.S. Case No. 60 of 2016 registered under Sections 302/34 IPC and Section 27 of the Arms Act.

It has been submitted on behalf of the petitioner that there is absolutely nothing against the petitioner and whatever allegation made is against other accused and only in some paragraphs of the case diary his name has been mentioned and he is in custody for about six months.

Heard learned APP also.

Learned APP has not controverted the aforesaid fact. Having heard both sides and considering the fact that allegation is made against other accused persons and the petitioner

Patna High Court Cr.Misc. No.50899 of 2016 (3) dt.28-01-2017 2/2 has remain in custody for six months, let the petitioner, Braj Kishore Mishra @ Kundan Mishra, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-VI, Darbhanga, in connection with A.P.M. P.S.Case No. 60 of 2016, subject to the conditions that one of the bailors should be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and further the petitioner will co-operate in the trial and make himself available in court on each and every date fixed and in the event of failure on his part to appear before the court on two consecutive dates, his bail bond shall be liable to be cancelled.
