1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 342, 323, 353, 379, 427, 504, 506 and 34 of the Indian Penal Code and under Section 135 of the Indian Electricity Act, 2003.
3. Learned counsel for the petitioner submits that the petitioner has antecedent of five cases and the informant alleges that a raid was conducted at the house of Ram Kumar and he was asked to pay the electricity dues of Rs. 25,837/-, on which Ram Kumar and his son assaulted the informant and snatched the list of dues which he was carrying. It is next alleged that thereafter petitioner along with Rahul came and started abusing
Patna High Court CR. MISC. No.23399 of 2023(2) dt.14-07-2023 2/3 and assaulting, it is further alleged that accused persons snatched a gold chain of the informant worth Rs. 60,000/- and also snatched Rs. 3,500/-

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, it is next submitted that petitioner is not related to Ram Kumar nor he had any concern with the raid. It is further submitted that being a co-villager he had also gone and when he saw that an altercation is taking place in between Ram Kumar, his son and the informant, on which he intervened and accordingly, came to be implicated. It is next submitted that from perusal of the allegation as alleged in the F.I.R., it would manifest that the allegations are general and omnibus in nature against the petitioner.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount
Patna High Court CR. MISC. No.23399 of 2023(2) dt.14-07-2023 3/3 each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Belaganj P.S. Case No. 658 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
7. One of the bailors of the petitioner shall be his father namely Ram Naresh Singh.
