Petitioner, who is in custody, seeks bail in connection with Gopalpur P.S. Case No. 310 of 2017 registered for the offences punishable under Sections 302, 120(B), 34 of the Indian Penal Code and Section 27 of Arms Act. Informant is the father of deceased who in his written complaint has stated that his son was killed by one Sonu @ Sonam Yadav for not paying ransom and fish to him. It has been submitted that petitioner is innocent and has been falsely implicated in this case. Allegation against the petitioner is that he was also present at the place of occurrence however there is no allegation of any overt act against the petitioner. Patna High Court Cr.Misc. No.69515 of 2018(2) dt.04-12-2018 2/2 occurrence is 08.12.2017 but F.I.R. was lodged on 10.12.2017. Informant is not the eye-witness but has named the accused on the basis of information received from persons who had accompanied deceased. Petitioner is in custody since 10.07.2018.
Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II, Naugachia, in connection with S.T.
