1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in connection with Bisfi (Patauna O.P.) P.S. Case No.191 of 2021 instituted under Section 363, 366A, 34 of the I.P.C.
3. As per the prosecution case, the informant has alleged that her daughter was kidnapped by the accused persons with a view to marry.
4. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in this case. He further submits that the victim is aged about 19 years old and had went to Delhi and solemnized marriage with co-
Patna High Court CR. MISC. No.22177 of 2026(4) dt.24-06-2026 2/3 accused Badri Sah and leading happy conjugal life. There is inordinate delay of about 54 days in lodging the F.I.R. Learned counsel submits that as per the statement of the victim, petitioners had co-operated in the solemnization of marriage of victim with the co-accused Badri Sah. He further submits that co-accused Badri Kumar @ Badri Kumar Sah had already been granted anticipatory bail by the Co-ordinate Bench of this Court vide order dated 06.11.2023 passed in Cr. Misc. No.33864 of 2023. Learned counsel submits that petitioners have got clean antecedent and they undertake to cooperate in the investigation and trial of the case.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.
6. Considering the facts and circumstances of the case, submissions of learned counsel for the parties, the nature of allegation leveled against the petitioners and their clean antecedent as well as the fact that similarly situated co-accused had already been granted anticipatory bail, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail upon furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount to each to the satisfaction of the
