JUSTICE PARTHA SARTHY ORAL ORDER 30-06-2020 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Darbhanga Mahila P.S. Case no. 12 of 2018 registered under sections 376, 504, 506 and 34 of the Indian Penal Code, sections 4 and 6 of the POCSO Act and sections 67, 67A and 67B of the Information and Technology Act.

It is submitted by learned counsel for the petitioner that the earlier application for bail of the petitioner was rejected vide order dated 7.8.2019 passed in Cr. Misc. no.19974 of 2019 giving liberty to the petitioner to renew his prayer for bail after completing one year in custody. Having heard learned counsel for the parties and taking into consideration the liberty granted vide order dated 7.8.2019 (Annexure-1) together with the petitioner being in custody since 23.1.2019, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Darbhanga Mahila P.S. Case no. 12 of 2018 on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge-cum-Special Judge (POCSO Act), Darbhanga.
