JUSTICE SANJAY PRIYA ORAL ORDER 09-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Bhagwanpur Hat P.S. Case No. 210 of 2016 instituted for the offence under Sections 341, 323, 324, 354, 379 and 504/34 of the Indian Penal Code.

It is alleged against the petitioner that he assaulted the informant with Dhab on his head. The learned Sessions Judge has mentioned about the injury of the informant which was 1/2" x 1/3" x 1/4" simple in nature.

From the written report, it appears that there is land dispute between the parties. From the order of learned Sessions Judge it appears that there is no repetition of blow by the petitioner.

Patna High Court Cr.Misc. No.10610 of 2017 (2) dt.09-03-2017 2/2 Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today, in connection with Bhagwanpur Hat P.S. Case No. 210 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
