The petitioner seeks bail in Brahampur P.S. Case No. 436 of 2018 instituted for the offence under Sections 25(i) (a), 26 and 30 of Arms Act.

Counsel for the petitioner submits that as per written report 94 pieces of swords kept in a sack of Jute and Plastic have been recovered from Hardware shop of the petitioner. Counsel for the petitioner further submits that petitioner was selling those swords on the occasion of Muharram festival. The articles seized by the police will not come under the purview of Arms Act.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the

Patna High Court Cr.Misc. No.70755 of 2018(2) dt.04-12-2018 2/2 petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar, in connection with Brahampur P.S. Case No. 436 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
