JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 14-09-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner wants to renew the prayer of bail which was earlier rejected by order dated 06.01.2016 passed in Cr. Misc. No. 45551 of 2015 on the ground that the petitioner is suffering in custody since 20.06.2015 having no criminal antecedent, he has not been put on test identification parade and further recovered amount has also not been put on test identification parade. The alleged recovery is not from the conscious possession of the petitioner and, as such, he deserves sympathetic consideration and further the trial has not been concluded within the time and the petitioner was given liberty to renew his prayer for bail.

The learned A.P.P. fairly submits that the petitioner

Patna High Court Cr.Misc. No.38153 of 2016 (2) dt.14-09-2016 2/2 was given liberty to renew his prayer for bail after six months. In the facts and circumstances stated above, the petitioner, above named, is directed to be released on bail on execution of bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Patna City in connection with Chowk P.S. Case No. 122 of 2015, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
