JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-03-2017 The petitioner is apprehending her arrest in connection with Jamui Mahila P.S. Case No. 51 of 2016, registered for offences punishable under Sections 376, 366A and 323 Indian Penal Code and Section 3 and 4 of the POCSO Act. It has been submitted on behalf of the petitioner that no allegation against the petitioner under the above Sections of Indian Penal Code as well as POCSO Act is made out against the petitioner as petitioner only happens to be the aunt of the main accused and she has been made accused in this case only on the basis of suspicion.

Having heard both sides, considering the facts and circumstances of the case, and the nature of allegation and also that petitioner only happens to be aunt of the main accused of this
Patna High Court Cr.Misc. No.12551 of 2017 (3) dt.29-03-2017 2/2 case, as such, let the petitioner above named, in the event of her arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-Cum-Special Judge, Jamui in connection with Jamui Mahila P.S. Case No. 51 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
