JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2018 The petitioner seeks regular bail in connection with Pranpur (Roshna) P.S. Case No. 87 of 2018 and G.R. Case No. 2674 of 2018, registered for offences punishable under Section 376 of the Indian Penal Code and Section 4 of the POCSO Act. Allegation against the petitioner is that he has committed rape upon the daughter of the informant, when she had gone to attend the call of nature.
Submission of learned counsel for the petitioner is that he has been made accused in this case only because he refused to marry with the daughter of the informant and to pressurize the petitioner this case has been lodged. It has further been submitted that in her statement recorded under Section 164 Cr.P.C., the girl stated that her mensuration was also stopped, which clearly shows that she was habitual and her age is about
Patna High Court Cr.Misc. No.71678 of 2018(3) dt.20-12-2018 2/2 17 years and the petitioner is in judicial custody since 06.07.2018.
Heard learned A.P.P. also, who opposed the prayer for bail of the petitioner stating that medical report also shows that the girl has used for sexual intercourse.
Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I cum Special Judge, Katihar, in connection with Pranpur (Roshna) P.S. Case No. 87 of 2018 and G.R. Case No. 2674 of 2018.
