2. The petitioner is apprehending arrest in connection with Kalyanpur P.S. Case No.- 376 of 2025 registered under sections 498A, 304B and 34 of the IPC lodged on 15.11.2025 by the informant, Ashutosh Kumar.
3. As per the prosecution story, the informant got married to Deepak Kumar in the year 2018. Once, she returned to her parents' place, this petitioner ensured that she moves alongwith him to a different place. The family tried to locate his sister but without any success. Years later, the 'Bhabhi' (sisterin-law) of the petitioner informed that she has come to

As the informant went to the place, found his sister who was unable to move or speak and was severally ill. She was shifted to Darbhanga Medical College and Hospital and then to PMCH, Patna. Ultimately, she breathed her last on 12.11.2025. The informant had reason to believe that she was subjected to mental and physical torture for want of dowry which resulted into deterioration of health and the ultimate death. This led to the FIR.
4. Learned counsel for the petitioner submits that admittedly, the marriage took place with Deepak Kumar, the case is that she returned and later eloped with this petitioner. However, contrary to that, he never went away with the married lady and it is a false implication.
5. Learned APP on the other hand submits that a perusal of the learned Sessions Judge order would show that immediately after the marriage, when the lady (deceased) returned home, he disappeared with her and the family had no clue about their location. After years, without any treatment of her, was handed over to the family members in a very bad health. She ultimately, breathed her last on 12.11.2025.
6. Taking into account the submissions of the parties
Patna High Court CR. MISC. No.20833 of 2026(2) dt.08-04-2026 3/3 and the role that has come against the petitioner in the present case, the unfortunate part is that the lady ultimately left this world, in that background, this Court is not inclined to extend him the privilege of anticipatory bail which is accordingly, rejected.
