JUSTICE SANJAY PRIYA ORAL ORDER 22-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Mahila P.S. Case No. 51 of 2016 instituted for the offence under sections 376, 366A and 323 of the Indian Penal Code.

It has been submitted that this petitioner is father of the main accused Sajan Kumar.

There is no allegation of any specific overt act against this petitioner either in the written report or in the statement of victim girl recorded under section 164 Cr.P.C. From the written report itself, it is apparent that Sajan Kumar established physical relationship with the victim girl on the pretext of marrying her and brought her to Gujarat and kept her there for seven days and continuously established physical

Patna High Court Cr.Misc. No.12188 of 2017 (2) dt.22-03-2017 2/2 relationship. Thereafter, the co-accused brought the victim to Jamui and when she put pressure on him to keep her at his house then co-accused Sajan Kumar brought her to Jamui bus stand and left her.

There is statement of victim girl recorded under section 164 Cr.P.C. which has been annexed as Annexure-2 in which also no allegation of any specific overt act has been levelled against this petitioner.

The petitioner is father of co-accused Sajan Kumar. Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner named above, within six weeks from today, in connection with Jamui Mahila P.S. Case No. 51 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Jamui, subject to the conditions as laid down under Section 438(2) Cr.P.C.
