The petitioner, who is in custody, seeks bail in connection with Nirmali P.S.Case No. 101 of 2016 registered under Section 30(a) of the Bihar Excise (Amendment)Act, 2016. Prosecution case, in brief, is that the petitioner was carrying a gunny bag and the police apprehended him and recovered 54 bottles of Nepali liquor each containing 300 ml. Learned counsel for the petitioner submits that the petitioner is a labourer and he was carrying the bag on payment of labour charges and he had no knowledge that there was liquor in the said gunny bag and he has got no criminal antecedent. Considering the small volume of recovery of Nepali liquor from the petitioner and having no criminal antecedent, he is
