JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-04-2019 This application, for grant of anticipatory bail, arises out of Motipur P.S. Case No. 1033 of 2018, disclosing offences under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act. Allegation as per F.I.R. is of recovery of 150.4 litres of liquor from hut of one co-accused Shashi Rout and it is said that co-accused Shashi Rout, petitioner and one Devanand Rai had kept the liquor there.

Submission of learned counsel for the petitioner is that he has no criminal antecedent and has falsely been implicated in this case and from the F.I.R itself it is evident that nothing has been recovered either from his possession or from his house.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Muzaffarpur, in connection with Motipur P.S.
