Petitioner seeks regular bail in connection with Sono P.S. Case No. 257 of 2020 registered for the offence under Section 399 / 402 of the I.P.C.
As per the allegation Police got information that 8-10 miscreants have assembled near Chiran Bridge in Batiya forest and are planning to commit dacoity, proceeded towards the place of occurrence and upon seeing the Police party they started fleeing away, however, one of the miscreants was arrested who disclosed his name as Yogendra Yadav @ Yogi Yadav (i.e. the petitioner ) and the name of other accused also and one country made Katta , one live cartridge and two mobile phones were recovered from the possession of the petitioner for which a separate F.I.R. has been lodged bearing Sono P.S. Case No. 258 of 2020.
Patna High Court CR. MISC. No.35187 of 2021(2) dt.04-01-2022 2/2 Learned counsel for the petitioner submits that for the same occurrence two FIRs have been lodged. In Sono P.S. Case No. 258 of 2020 which has been lodged for recovery of illegal fire arms from the possession of the petitioner, he has been released on bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 34352 of 2021. He next submits that petitioner is in custody since 22-12-2020.
Regard being had to the submissions made by the parties and taking into consideration the materials available on record, the fact that petitioner has been granted bail in connected case bearing Sono P.S. Case No. 258 of 2020 by a Co-ordinate Bench of this Court, he is in custody since 22/12/2020 and charge sheet has already been submitted, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of Smt. Bharti Kumari, learned JM 1st Class, Jamui in connection with Sono P.S. Case No. 257 of 2020. praful/- (Anil Kumar Sinha, J) U T
