Petitioner seeks bail in a case registered for the offences punishable under Sections 336,418 of the Indian Penal Code and 18A, 18C, 27B(ii),18B,28,28A,36,AC Drug and Cosmetic Act 1940 and Amended Act 2008.

Prohibited and band drugs were allegedly recovered from possession of the petitioner when the petitioner was carrying the same for Nepal. Petitioner has stated on oath that he has got no criminal antecedent and he is in custody since 25.11.2018.

Considering the entire facts, let the petitioner, above named, be released on bail after framing of the charges

Patna High Court CR. MISC. No.20005 of 2019(2) dt.01-05-2019 2/2 or completion of nine months of custody whichever is earlier on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Kanhauli Police Station Case No.151 of 2018, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
