JUSTICE ANIL KUMAR SINHA ORAL ORDER 15-09-2020 Heard Mr. Virendra Kumar, learned counsel for the petitioner and Mr. Anil Prasad Singh, Additional Public Prosecutor for the state through video conferencing.

2. Petitioner seeks regular bail in connection with Case No. C2/18/20 registered for the offence punishable under Section 30(A) of Bihar Prohibition and Excise Act.

3. The allegation against the petitioner as per First Information Report is that the S.S.B officials, during course of patrolling, intercepted the motorcycle of the petitioner and recovered total quantity of 66 litres of illicit Nepali Saunfi liquor.

4. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedents and has falsely been

5. Learned counsel further submits that petitioner is in custody since 07.01.2020.

6. Having regard to the submissions made by the parties and taking into consideration the fact that petitioner has got no criminal antecedent and is in custody since 07.01.2020, I am inclined to grant regular bail to the petitioner.

7. Accordingly, let the petitioner, MUKESH RAUT be released on bail, if he is not required in any other case, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ADJ-II-cum-Special Judge, Excise Act, Sitamarhi in connection with Case No. C2/18/20.

8. It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines regarding lockdown and social distancing.
