Petitioner seeks bail in a case registered for the offences punishable under Sections 420, 34 of the Indian Penal Code.

Petitioner is said to have taken Rs. 1,50,000/- from the informant at the time of settlement of marriage of his son with daughter of the informant but subsequently, he refused to get the marriage solemnized.

Earlier petitioner was granted privilege of

Patna High Court Cr.Misc. No.45598 of 2016 (3) dt.09-12-2016 2/2 anticipatory bail subject to condition that he shall return Rs. 1,50,000/- to the informant but submission on behalf of the petitioner is that due to his poverty petitioner could not return the above stated amount and chose to surrender before the court below and accordingly, he surrendered on 22.07.2016 and since then he is languishing in jail custody.

Considering the aforesaid facts and circumstances as well as period of detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Dihari, Rohtas in connection with Dihari (Indrapuri) P.S. Case No. 163 of 2016.
