JUSTICE SHIVAJI PANDEY ORAL ORDER 24-10-2016 Heard learned counsel for the petitioner and learned counsel for the State.

In this case, the petitioner is seeking bail in connection with Nawanagar P.S. Case No. 48 of 2015 registered for offences under sections 406, 420 of the Indian Penal Code. In the present case, an allegation has been made that the paddy was supplied to the miller. During investigation, the name of the petitioner has been included in the category of accused persons and it has been found that the petitioner was also involved in the manipulation.

Learned counsel for the petitioner has submitted that

Patna High Court Cr.Misc. No.39467 of 2016 (3) dt.24-10-2016 the petitioner was the in-charge of Paddy Procurement Center, Nawanagar, his task was only to procure rice and sent the same to the depot where the paddy was kept and from there it goes to the concerned rice mill. So, the petitioner is not directly involved in the supply of paddy to the mill. The petitioner is in judicial custody since 18.7.2016.

Looking to the facts and circumstances of the case, let the petitioner, namely, Sheo Kumar Rai, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Nawanagar P.S. Case No. 48 of 2015.
