Mr. Arun Kumar Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 01-02-2022 Heard the learned counsel for the petitioners as well as the learned Additional Public Prosecutor for the State through video conferencing.

The learned counsel for the petitioners is directed to remove all the defects pointed out by the office within one month.

The petitioners apprehend their arrest in connection with Ladaniya P.S. Case No. 37 of 2020 registered for offence punishable under sections 147, 148, 341, 323, 324, 325, 379, 504, 506/34 of the Indian Penal Code.

No.31654 of 2021(2) dt.01-02-2022 2/3 As per FIR, the accused persons came in the courtyard of the informant and they assaulted him with stick, garasa, farsa, iron rod etc. The specific allegation against petitioner no. 1 is that he inflicted sword blow on the head of Pappu @ Jay Narayan Yadav. He also inflicted farsa blow on the head of Saroj Yadav. Petitioner no. 2 assaulted with iron rod on the head of the informant.

The learned counsel for the petitioners has submitted that there was a previous enmity between both the parties and the members of petitioners side have also been seriously injured. In this respect, a counter case has been filed by Paro Devi, the wife of co-accused Ram Prasad Yadav as Ladaniya P.S. Case No. 38 of 2020.

The specific allegation against petitioner no. 1 is that he inflicted sword blow on the head of Pappu @ Jay Narayan Yadav and he also assaulted Saroj Yadav on his head with Farsa. The injuries were found on the person of Saroj Yadav, which are grievous in nature and attributed against petitioner No. 1. As such, the prayer for anticipatory bail of petitioner No.1 is hereby rejected.

So far as petitioner nos. 2 to 4 are concerned, their prayer for bail is allowed and let they, in the event of their arrest or surrender, within four weeks from today, be released on bail on

No.31654 of 2021(2) dt.01-02-2022 3/3 furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with Ladaniya P.S. Case No. 37 of 2020, subject to condition as laid down under section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioners within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
