2. The accused/petitioner seeks bail in connection with Kamtaul P.S. Case No. 338 of 2024 registered for the offences under Sections 64, 351(2), 352, 3(5) of the Bhartiya Nyay Sanhita, 2023 (in short, the 'B.N.S.').

3. Admittedly, petitioner and informant/victim both are major.

4. Learned counsel appearing for the petitioner submitted that provisional bail was granted in terms of order dated 01.09.2025 for fifteen days on the basis of affidavit

5. It is submitted by learned counsel appearing for the informant/victim that the victim is also ready to marry petitioner.

6. It is jointly submitted that due to certain misunderstanding as developed between the parents of both parties, the marriage between the petitioner and the informant/victim could not solemnize. It is submitted by learned counsel for the informant/victim that the father of informant/victim is living outside the country in his professional capacity and, therefore, negotiation is not possible.

7. In view of the aforesaid factual submission and by taking note of the fact as parties are major, they are ready and willing to solemnize their marriage, accordingly, abovenamed petitioner is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga/concerned
