JUSTICE BIRENDRA KUMAR ORAL ORDER 17-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341/323/324/307/504/34 of the Indian Penal Code. Allegation against the petitioner is that they committed assault against the informant. Petitioner Sanjay Tiwari assaulted with garasa causes injury on the palm. Learned counsel for the petitioner submits that wife of petitioner Punam Devi lodged Vaishali P.S. Case No.29 of 2017 against the father of the informant of this case and informant and others were pressurizing for withdrawal of the aforesaid criminal case.

Considering the background and nature of allegation,

Patna High Court Cr.Misc. No.12850 of 2017 (2) dt.17-03-2017 2/2 let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur/Successor Court in connection with Vaishali Police Station Case No.343 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
