JUSTICE SUDHIR SINGH ORAL ORDER 18-01-2017 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case instituted for the offences under Section 392 of the I.P.C.

Earlier the bail application of the petitioners was rejected with an observation 'at this stage'. In the light of the said observation the present application has been preferred on behalf of the petitioners.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 2.3.2016 and the charge has already been framed in the case. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have remained in custody for approximately 11 months.

Patna High Court Cr.Misc. No.49121 of 2016 (3) dt.18-01-2017 2/2 On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Jamui P.S. case No.14 of 2016.

It is further directed that the petitioners shall be present on each and every date during the trial. If the petitioners do not co-operate during the trial the trial court will be at liberty to cancel the bail of the petitioners.
