ANJANA MISHRA ORAL ORDER 10-09-2015 Heard learned counsel for the petitioner and learned counsel for the opposite party no. 2. The petitioner apprehends his arrest in connection with Complaint Case No. 906 of 2012 registered for the offences punishable under Sections 498A of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.

Considering the nature of allegations made against the petitioner and the fact that there is irretrievable break down and also because divorce proceeding is pending adjudication, it is hereby directed that the petitioner pay the interim amount of Rs. 15,00/- per month in the court below by the 15th of each month beginning from today. In the event petitioner deposits the aforesaid amount by the 20th of this month, let the petitioner, in the event of his arrest or surrender before the

No.5009 of 2014 (12) dt.10-09-2015 Court below within a period of three weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Gaya in connection with Complaint Case No. 906 of 2012, subject to the conditions as laid down under Section 438 (2) of the Cr. P.C.

However, it is made clear that if the petitioner fails to deposit the amount fixed above for two consecutive months, it shall be open for the opposite party no. 2 to take appropriate steps for cancellation of the bail.
