JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-10-2015 Heard learned counsels for the petitioner and the State. The petitioner being Headmaster of the Girls High School, Nabinagar, is apprehending arrest in a case registered for the offences punishable under Sections 409 and 506/34 of the Indian Penal Code.

The prosecution case is that the clerk of the school gave three hundred rupees less to each of the students under C.M. bicycle scheme. The petitioner is not named in the FIR. His name subsequently sprang up during investigation.

It is submitted by the learned counsel for the petitioner that accusation is specific against the clerk. More over, there is nothing on record to suggest that three hundred rupees less was

Considering the nature of irregularity alleged and the petitioner's name being sprang up during investigation, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Aurangabad in connection with Nabinagar P.S. Case No.16 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
