The petitioner prays for regular bail for the offence under Sections 302 and other sections of Indian Penal Code and Section 27 of Arms Act.

Allegedly, in the occurrence, Kajal Yadav and the petitioner shot Hareram Paswan resulting Hareram Paswan and Bijan Yadav died and petitioner along with other co-accused threw the dead bodies in river Koshi.

Submission is of false implication and the petitioner is not the assailant in this case and the other co-accused have been allowed bail to which the learned Additional Public Prosecutor opposes by submitted that during investigation, the witnesses have supported the prosecution version and the petitioner is one of the assailant causing

Patna High Court Cr.Misc. No.51868 of 2016 (4) dt.09-02-2017 2/2 death of deceased Hareram Pawan.

In the facts and circumstances stated above, considering the allegation attributed against the petitioner serious in nature, I am not inclined to enlarge the petitioner on bail and accordingly, his such prayer stands rejected. (Jitendra Mohan Sharma, J.) rinkee/- U T
