The petitioner seeks bail in connection with Forbesganj P.S. Case No. 79 of 2018 instituted for the offence under Section(s) 302/34 of the Indian Penal Code. Learned counsel for the petitioner has submitted that petitioner is not named in the written report. There is no recovery of any incriminating article from possession of this petitioner. Police has recorded the confessional statement of this petitioner after arresting him in Forebesganj P.S. case on. 89/18 and thereafter remanded in the instant case on 9.03.2018 and since then he is languishing in jail custody. It has further been submitted that other co accused with similar allegation has already been granted regular bail by this Hon'ble High Court

Patna High Court Cr.Misc. No.69964 of 2018(2) dt.03-12-2018 2/2 vide order dated 04.10.2018 passed in Cr. Misc. no. 55125 of 2018.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Forbesganj P.S. Case No. 79 of 2018, subject to the condition that both the bailers shall be the close relative of the petitioner (Sanjay Priya, J) shyambihari/- U T
