The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 332, 353, 504 and 506 of the Indian Penal Code and Section 135 of the Electricity Act. It is a case of theft of electricity by running a flour mill and rice mill. The total loss calculated by the Electricity Company is Rs. 13,79,638/-.

It is submitted by learned counsel for the petitioners submits that petitioners have falsely been implicated in this case and they applied for getting

Patna High Court CR. MISC. No.22077 of 2022(2) dt.29-09-2022 2/3 connection of electricity. He further submits that the petitioners are ready to deposit 25% of the loss incurred to the electricity department.

However, the petitioners are ready to pay 25 percent of the loss incurred to the electricity department and in this respect, the petitioners agree to pay Rs. Two lacks to the electricity department and rest Rs.1,20,000/- be deposited within two months in two consecutive installments (60,000/- each) In the facts and circumstance of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail for a period of three months, on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Special Judge (Electricity) Magadh Area, Gaya in connection with Dinara P.S. Case No. 22 of 2021, subject to the conditions as laid down under Section

Patna High Court CR. MISC. No.22077 of 2022(2) dt.29-09-2022 3/3 438(2) of the Cr.P.C.

The bail bonds of the petitioners shall be accepted by the learned Court below on showing receipt of Rs. Two lacks paid in favour of Electricity Company by the petitioners.

The aforesaid payment will be subject to the outcome of the case.
