Regard being had to the Supreme Court decision in the case of Pokar Ram v. State of Rajasthan and Anr. reported in AIR 1985 SC 969 and the finding that the petitioner is named in the FIR under Section 302 IPC, let the above named petitioner surrender and pray for regular bail before CJM, Sitamarhi in connection with Sitamarhi P.S. Case No.811 of 2013 which shall be considered strictly as per the allegations appearing against the petitioner and not otherwise without being prejudiced by the fact that he had approached this Court as well under Section 438 Cr.P.C.

With the above observation, this petition stands disposed of.
