This application for regular bail arises out of Excise Case No. 180 of 2020, disclosing offences punishable under Section 30(A) of Bihar Prohibition and Excise (Amendment) Act, 2016 and Section 30 of the Arms Act, 1959. The petitioner's application for regular bail was rejected by the Court of Special Judge, Excise by an order dated 16.03.2020, passed in Excise Case No. 180 of 2020. Learned counsel appearing on behalf of the petitioner has submitted that subsequently learned Special Judge, Excise has granted regular bail to another co-accused, similarly situated, by an order dated 25.05.2020.

Considering the facts and circumstances, this

No.20030 of 2020(2) dt.19-06-2020 2/2 application is disposed of with an observation that the petitioner shall be at liberty to renew his prayer for bail before Court below, citing the example of other co-accused having been granted bail by learned Special Judge by an order dated 20.05.2020.
