====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-01-2022 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in registered for the offences punishable under section 302 and other sections of the Indian Penal Code and section 27 of the Arms Act. As per the prosecution case, this petitioner is alleged to have fired on the chest of the cousin brother of the informant causing his death.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Informant is not the eye witness and there is land dispute between the parties. Petitioner has got clean antecedent as stated in paragraph 3 of the bail petition. Petitioner is in custody since 24.1.2020.

Patna High Court CR. MISC. No.31001 of 2021(3) dt.06-01-2022 2/2 Learned counsel appearing for the State opposes the prayer for bail. He submits that there is specific allegation that this petitioner fired on the chest of the cousin brother of the informant causing his death.

Considering the nature of accusation against the petitioner, his prayer for bail is refused.
