JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-10-2015 Heard learned counsels for the petitioner and the State. The petitioner being the Panchayat Electrical Assistant is apprehending arrest in a case registered for the offences punishable under Sections 409, 420/34 of the Indian Penal Code. The accusation is that in violation of guidelines of MANREGA, in the year 2011-12 in Scheme nos. 3, 4 and 5 the irregularity was committed and thereby government funds were misappropriated.

It is submitted by learned counsel for the petitioner that the petitioner has deposited the misappropriated amount alleged against him.

Considering the aforesaid facts, let the above named petitioner be released on provisional anticipatory bail for three months, in the event of arrest or surrender before the learned Court

Patna High Court Cr.Misc. No.42830 of 2015 (2) dt.15-10-2015 2/2 below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Begusarai in connection with Naya Gaon P.S. Case No. 38 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.

The provisional bail of the petitioner will be confirmed by learned court below on verification of the fact that the petitioner has deposited the alleged misappropriated amount. But if it is found that the petitioner did not deposit the alleged misappropriated amount then the petitioner will surrender and pray for regular bail.
