JUSTICE SANJAY PRIYA ORAL ORDER 17-05-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Gayghat P.S. Case No. 229 of 2016 instituted for the offence under Sections272, 273, 120B of the Indian Penal Code and Sections-30(A), 35(A) of Bihar Prohibition and Excise Act, 2016. As per written report, 144 bottles of 375 ml. of Royal Stag foreign liquor was recovered from a Magic vehicle, on which, the petitioner is said to be sitting along with another coaccused Santosh Kumar. In such circumstances, keeping in view that the petitioner is named in the written report and he has been found sitting in the aforesaid vehicle and foreign liquor was recovered from that vehicle, this court is not inclined to grant anticipatory

Patna High Court Cr.Misc. No.18489 of 2017 (2) dt.17-05-2017 bail to the petitioner. Accordingly, prayer for anticipatory bail stands rejected.

The petitioner is directed to surrender in the court below and seek regular bail which shall be considered and disposed of same day in accordance with law without being prejudiced by this order, particularly, taking into account the fact that the petitioner has no criminal antecedent.
