30-11-2018 Heard Sri Ravindra Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, having clean antecedent and is in custody since 01-10-2018 in Excise Case No. 1575 of 2018, arising out of Ara Rail P.S. Case No. 85 of 2018, registered for offence under Section 30(a) of Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail.

It has been argued by learned counsel for the petitioner that petitioner had got down from Kota-Patna Express at Ara railway station and to the reasons best known to the police, he was apprehended, as if, he was carrying a bag containing about 21.5 liters of Indian make foreign liquor. It has been argued that there was no bag in possession of the petitioner, rather one bag was lying near the petitioner and on

Considering the nature of accusation and clean antecedent, let the petitioner namely Satya Prakash @ Bholu be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 4th Additional District and Sessions Judge cum Special Judge (Excise), Bhojpur at Ara in connection with Excise Case No. 1575 of 2018, arising out of Ara Rail P.S. Case No. 85 of 2018.
