Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 325, 452, 427, 337, 379, 504, 506 of the Indian Penal Code.
The prosecution case is that the three petitioners and co-accused Shankar Ram assaulted the informant with iron rod and hockey stick, when informant after sustaining injury fell down, then cousin brother and mother of the informant came to rescue, but they were also assaulted by the accused persons. The accused persons damaged the house hold articles and took away lap top and mobile. It is submitted by the learned counsel for the
Patna High Court Cr.Misc. No.43001 of 2015 (2) dt.15-10-2015 petitioners that accusation of assault is omnibus and general. There is specific allegation of informant that he received injury on the head, but the injury report does not reflect injury on the head. Though the injury has been found grievous, but not on vital part of the body. The wife of the accused Shankar Ram is Ward Member and the informant's side used to abuse and humiliate her for which she lodged a complaint before the District Magistrate on the date of occurrence. Considering the accusation of assault being omnibus and general and statement has been made in para-3 of the petition that petitioners have no criminal antecedent, let the learned court below consider the prayer for regular bail of the petitioners, if they surrender before the learned court below within a period of six weeks from today in connection with Lakhisarai P.S. Case No. 311 of 2015, pending in the court of learned Chief Judicial Magistrate, Lakhisarai. With the above observation this application is disposed of.
