The petitioner seeks bail in Bahadurpur P.S. Case No. 238/2016 registered under Sections 324, 307, 34 of the Indian Penal Code and Sections 25(1-B)A, 26, 27 and 35 of the Arms Act.

The informant named Hari Shankar Jha, who has fired at her son Indrajit Kamti @ Sanjay. Hari Shankar Jha was apprehended on the spot and from his possession, arms and ammunitions were recovered. Hari Shankar Jha disclosed the name of the petitioner as the person who had supplied arms to him. The petitioner is not the assailant of the injured. Similarly situated co-accused Gulshan Choudhary has already been enlarged on bail vide order passed in Cr. Misc. No. 48895/2016. The petitioner is in jail since 19.07.2016.

No.54460 of 2016 (2) dt.12-01-2017 2/2 Considering the fact that the petitioner is not the assailant of the son of the informant and the petitioner is in jail for about six months, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in Bahadurpur P.S. Case No. 238 of 2016.
