The petitioner is apprehending his arrest in connection with Bakhtiyarpur P.S.Case no.31 of 2019 , registered for offences punishable under Sections 376, 511 of the Indian Penal Code and Section 12 of the POCSO Act dated 17.1.2019. Prosecution story is that the petitioner entered inside the house of the informant in the night and caught hold the hands of the informant and when she protested , her frock was torn and fled away.

Submission of the learned counsel for the petitioner is that there was dispute with respect to drainage and he has falsely been implicated in this case.

No.21652 of 2019(2) dt.10-05-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below on the basis of materials available on the record and if possible to be disposed of. With the aforesaid direction, this application is dismissed.
