JUSTICE SUDHIR SINGH ORAL ORDER 17-10-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 47(A)/67 of the Excise Act.
Allegation is that from the house of petitioner Nepali wine has been recovered.
It has been submitted on behalf of petitioner that he is in custody since 26.8.2016. Chargesheet has been submitted against petitioner. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against petitioner. Four bottles of Nepali wine are said to have been recovered. There is no compliance of Section 100 of the Code of Criminal Procedure.
On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Patna High Court Cr.Misc. No.44369 of 2016 (2) dt.17-10-2016 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Sheohar, in connection with Purnahiya P.S.
