JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-12-2018 Heard learned counsels for the petitioners and State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 366, 366A, 504 and 506/34 of the IPC.

The prosecution case, as per the written report of Ramanand Yadav, dated 25.05.2018, submitted to the Station House, Sour Bazar Police Station, is to the effect that on 21.05.2018 at 5 PM, the daughter of the informant, namely Anshu Kumari, aged about 14 years was taken by petitioner nos. 1 and 2 and co-accused Bidur Yadav to market for purchase of notebook and pen, but she did not return and when the informant went enquire about his daughter at the door of Arjun

Patna High Court Cr.Misc. No.69942 of 2018(2) dt.05-12-2018 2/3 Yadav, then he was abused by all the accused persons. It is submitted by learned counsel for the petitioners that for the occurrence of 21.05.2018, the written report was submitted on 25.05.2018. Thrust of accusation is against coaccused Bithur Yadav, who performed marriage with the victim and both are cohabiting together as husband and wife. Petitioners are the sister, mother and other family members of co-accused Bithur Yadav. A statement has been made in paragraph no.3 of the petition that the petitioners are not having any criminal antecedent.

Learned APP submits that there is specific accusation against the petitioners.

Considering the fact that the thrust of accusation is against Bithur Yadav, coupled with the statement made in paragraph no.3 of the petition that the petitioners are not having any criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of arrest/surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Sour Bazar (Police Camp Baijnathpur) P.S.
