Petitioner, Jai Prakash @ Jai Prakash Singh @ Chhotu, is in custody since 13.06.2016 in Bikrampur P.S. Case No. 122 of 2016 under Sections 457 and 380 of the Indian Penal Code.
According to the prosecution case, on hearing the sound of Khut Khut the informant awoke and saw the petitioner along with other co-accused persons fleeing away from the roof of the informant. Except this allegation, stated above, nothing has been recovered from the possession nor there is any allegation that anything has been looted or taken away by the petitioner and the accused persons.
Considering the above facts and circumstances of the
Patna High Court Cr.Misc. No.39203 of 2016 (2) dt.17-09-2016 case, I direct that the petitioner be released on bail on furnishing bail bond of Rs.5,000/- (Rupees five thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Rohtas at Sasaram in connection with Bikrampur P.S. Case No. 122 of 2016.
