In the present case, the petitioner is seeking bail in connection with Sessions Trial No. 93 of 2020 arising out of Revilganj P.S. Case No. 258 of 2019 registered for offences punishable under Section 302 of the Indian Penal Code. The allegation has been made that the son of the informant had gone along with his friend to see ailing father of Jitendra Kumar, but his son did not return and on the next day, the dead body of the son of the informant was recovered. Counsel for the petitioner submits that earlier the petitioner had filed a Cr. Misc. No.342 of 2020 for grant of bail, which was rejected by this Court vide order dated 25.02.2020 with a liberty to renew his prayer for bail after framing of
Patna High Court CR. MISC. No.23841 of 2020(5) dt.29-01-2021 2/2 charge and the charge has already been framed on 25.02.2020 (Annexure-3). It is urged that the petitioner and his father have falsely been implicated in the present case and his father, namely, Shila Nath Choubey has already been granted bail by a coordinate Bench of this Court vide order dated 19.03.2020 passed in Cr. Misc. No. 77999 of 2019.
Considering the entire facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional District and Sessions Judge-13, Chapra, Saran in connection with Sessions Trial No. 93 of 2020 arising out of Revilganj P.S.
