The petitioner apprehends his arrest in Saharsa P.S. Case No. 129/2014, registered for the offences punishable under Section 302 and other sections of the Indian Penal Code. The petitioner was granted anticipatory bail vide order passed in Cr. Misc. 21688/2014 with condition that the petitioner has got no criminal antecedent.
The petitioner surrender in the court below and he was granted provisional bail, but on enquiry it transpired that the petitioner has got criminal antecedent and as many as four criminal cases are pending against the petitioner. On such his provisional bail was cancelled. Petitioner again moved for anticipatory bail.
Patna High Court Cr.Misc. No.42169 of 2015 (3) dt.10-11-2015 2/2 Considering the fact that on the statement of the petitioner that he has got no criminal antecedent, the petitioner was granted anticipatory bail, but later on four criminal cases were found pending against the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
However, the petitioner, if so advised, may surrender before the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail and his prayer shall be considered on its own merit without being prejudiced by this order, taking into consideration, that other accused persons have already been enlarged on bail.
