Petitioner seeks bail in a case registered for the offences punishable under Sections 304(B) and 120(B)/34 of the Indian Penal Code.

The petitioner is elder brother of the husband. Husband is also in custody. Victim Ruby Devi died within seven years of her marriage in matrimonial house and allegation is general and omnibus against all the F.I.R. named accused including the petitioner that they have committed death of the victim for dowry.

Submission of the petitioner is that a partition suit is already going on with the husband of the deceased and the petitioner is separate from the husband of the deceased. The

Patna High Court Cr.Misc. No.42709 of 2016 (3) dt.13-12-2016 petitioner is in custody since 15.06.2016.

Considering the aforesaid facts, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IX, Gaya/Successor Court in connection with Tekari P.S. Case No. 110 of 2016.
