The petitioner apprehends his arrest in connection with Complaint Case No. 1375C of 2016, registered under Sections 420, 467, 468 and 471 of the Indian Penal Code. The accusation is that complainant, Ram Binay Sah, approached, to Sanjay Motani, proprietor of Auto Agency, for purchasing the tractor, where petitioner was doing the job as agent. On negotiation, complainant-opposite party no. 2 purchased the tractor and in that course, account of complainant was opened and nine cheques of the complainant were detained by Sanjay Motani, proprietor of Auto Agency, out of which, one

Learned counsel for the petitioner submits that it would appear from the complainant petition that the allegation is against co-accused, Sanjay Motani, proprietor of Auto Agency, and petitioner being an agent of Auto Agency, has falsely been implicated in this case and petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Complaint Case No. 1375C of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
