Mrs. Sharda Kumari ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 26-11-2020 Heard Mr. Amrendra Kumar, learned counsel for the petitioner and Mrs. Sharda Kumari, learned counsel appearing for the State through video conferencing.

Petitioner seeks regular bail in connection with Barauni Rail P.S. Case No. 141 of 2019, G.R. No. 127 of 2019 registered for the offence under Section 401, 414 of the I.P.C. The allegation as per the First Information Report is that Police on the basis of an information raided Dularuwa Dham temple and found three persons were sitting in dark near a well under a tree and upon seeing the police party they started fleeing away, however, petitioner was arrested by the Police and one lady hand bag has been recovered from the possession of the petitioner which was stolen.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case and one vanity bag has been recovered from the petitioner containing some items like mobile phone, bunch of keys, ordinary mangal sutra

Patna High Court CR. MISC. No.26459 of 2020(4) dt.26-11-2020 2/2 and items for face make up. Learned counsel further submits that petitioner has got no criminal antecedent of similar nature and he is in custody since 15.11.2019.

Having heard learned counsel for the parties and taking into consideration the materials available on record and the fact that petitioner is in custody since 15.11.2019, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Rail Judicial Magistrate, Barauni, Begusarai in connection with Barauni Rail P.S. Case No. 141 of 2019.

It is made clear that at the time of furnishing bail bond all the parties shall follow the guidelines regarding social distancing.
